General Terms and Conditions

§1 Scope of Application

  1. The following General Terms and Conditions (GTC) apply to all business relationships between Badzeit Fliesen und Mehr and the customer in the version valid at the time of the order.
  2. "Consumers" within the meaning of these terms and conditions are natural persons with whom we do business without attributing a commercial or self-employed professional activity to them. "Entrepreneurs" are natural or legal persons or partnerships with legal capacity who enter into business relationships with us while acting in the exercise of their commercial or self-employed professional activity.

§2 Conclusion of Contract

  1. The presentation of products in our online shop does not constitute a legally binding offer but an invitation to order. By clicking the "Buy" or "Submit Order" button, you place a binding order for the goods in the shopping cart. The confirmation of receipt of the order and its acceptance is sent immediately after placing the order via automated email. The purchase contract is concluded with this email confirmation.
  2. If the delivery of the goods ordered by you is not possible, for example, because the goods are not in stock, we will refrain from issuing a declaration of acceptance. In this case, no contract is concluded. We will inform you of this without delay and refund any consideration received immediately.

§3 Prices and Taxes

  1. All prices listed on the product pages are inclusive of the statutory value-added tax (VAT) applicable in Germany.
  2. For deliveries to other EU countries, the applicable VAT rate of the respective country will be applied in accordance with EU regulations.
  3. For deliveries to non-EU countries (e.g., Switzerland or Great Britain), prices are shown without VAT. Additional customs duties, taxes, or fees may apply in the destination country. These costs are to be borne by the customer and are not covered by us. Please contact your local customs office for further details.

§4 Shipping and Delivery

§5 Payment Terms

  1. Payment can be made via advance payment, bank transfer, or PayPal.
  2. You are only entitled to offset claims if your counterclaims have been legally established, are undisputed, or have been acknowledged by us in writing.
  3. You may only exercise a right of retention if your claims arise from the same contractual relationship.

§6 Warranty

  1. The statutory warranty period applies to all goods delivered to consumers within the European Union, Great Britain, and Switzerland. This period is two years from the delivery date.
  2. Warranty claims are limited to defects that existed at the time of delivery. Any damages caused by improper handling, installation, or use are excluded from the warranty.
  3. For entrepreneurs, the warranty period is 12 months from the delivery date unless otherwise agreed in writing.

§7 Geoblocking

  1. We comply with the European Geoblocking Regulation (EU 2018/302). Customers from all EU countries are entitled to the same terms and conditions regarding product prices and availability. However, shipping costs may vary depending on the destination country.
  2. Customers outside the EU, such as in Great Britain or Switzerland, may be subject to different conditions due to customs or tax regulations.

§8 Retention of Title

The goods remain our property until full payment has been made.

§9 Product Representations

  1. The images and photographs of the products on our website are for illustrative purposes only and may differ from the actual products. In particular, color deviations may occur due to different screen settings.
  2. The product images are therefore not binding. Binding are only the descriptions, details, and features listed in the product description.

§10 Governing Law and Jurisdiction

  1. These terms and conditions are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
  2. If you are a consumer with your habitual residence in the European Union, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence.
  3. For entrepreneurs, legal entities under public law, or special funds under public law, the exclusive place of jurisdiction is the registered office of our company.
